Terms of Use
Please read these Terms of Use ("Terms") carefully before downloading, installing, registering, or using the TrustSaathi mobile application and its associated services (collectively, the "Services"). These Terms constitute a binding legal agreement between you ("User," "Resident," "Visitor," "Administrator," or "Security Staff") and TrustSaathi Developer Team ("we," "our," "us," or the "Developer").
By accessing or using the Services, you represent that you have the authority to bind yourself (or the entity you represent) to these Terms, and you agree to be bound by them. If you do not agree to these Terms, do not install, access, or use the Services.
1. Description of Services
TrustSaathi is a mobile-based visitor management and community security solution. The Services include:
- Digital gate check-in systems for visitors, delivery agents, and service providers.
- Real-time notifications and approvals for residents.
- Society administration tools, including registration and subscription management.
- An in-app wallet and digital payment ledger for subscription renewals and society dues.
The Developer reserves the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.
2. Account Registration and Security
- Eligibility: You must be at least 18 years of age (or have the consent of a parent/legal guardian) to create an account.
- Information Accuracy: You agree to provide accurate, current, and complete information during registration and keep your profile updated.
- Verification: You consent to phone number verification via One-Time Passwords (OTP) and, if applicable, profile photo/ID check verification requested by your housing society.
- Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.
3. User Categories and Responsibilities
A. Residents
You agree to utilize the App solely for authorizing legitimate visitors to your specific household. You must not falsely approve unauthorized individuals or abuse the security notification system.
B. Visitors
You agree to provide true, accurate, and up-to-date identification information (including name, phone number, and photo) at the security gate. You agree to adhere to the housing society's internal rules, guidelines, and access limitations.
C. Housing Societies & Administrators
Societies must verify the identity and residency of users claiming to reside in their community before approving their accounts. Administrators are responsible for handling community data in compliance with local privacy regulations (e.g., India's Digital Personal Data Protection Act, 2023).
4. Wallet and Financial Transactions
TrustSaathi provides a digital wallet system to facilitate subscription payments, utility billing, and society maintenance transactions.
- Payments: Payments are processed through secure third-party payment gateways (e.g., Razorpay). By initiating a transaction, you agree to comply with the terms of the third-party payment gateway.
- Refund Policy: All subscription payments, wallet top-ups, and transaction fees are non-refundable unless explicitly stated otherwise or required by law.
- Errors & Disputes: If you suspect an error or unauthorized transaction on your wallet, you must report it to us at mtechshop5@gmail.com within 7 days of the transaction date.
- Account Suspensions: We reserve the right to freeze wallet balances or restrict transactional capabilities if we suspect fraudulent, illegal, or unauthorized activity on your account.
5. Subscriptions and Kiosk Access
- Billing: Societies must maintain an active, paid subscription to access self check-in gate kiosks and administrative features.
- Expiration: If a society's subscription expires, self check-in services and associated visitor log submissions will be suspended automatically until renewal payment is processed.
- Pricing: We reserve the right to alter subscription tiers and pricing models with reasonable prior notice to society administrators.
6. Prohibited Conduct
You agree not to:
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a society, resident, or delivery service.
- Use the App to bypass physical security checkpoints or enter restricted areas without authorization.
- Manipulate, bypass, or override OTP verification or other security mechanisms.
- Reverse engineer, decompile, modify, or create derivative works of the App.
- Deploy automated bots, scrapers, or scripts to harvest logs or user information from the platform.
- Use the Services to transmit spam, harassment, or malicious content.
7. Intellectual Property Rights
All rights, titles, and interests in and to the TrustSaathi app (including but not limited to the source code, design, logos, graphics, database structures, and trademarks) are owned exclusively by TrustSaathi Developer Team and are protected by applicable copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for its intended purposes under these Terms.
8. Limitation of Liability and Disclaimer of Warranties
- As-Is Basis: The App and Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Security Disclaimer: TrustSaathi is a facilitation and record-keeping tool. It does not replace physical security guards, law enforcement, or homeowners' insurance. We do not guarantee that the App will prevent unauthorized access, intrusion, theft, property damage, or physical harm.
- Third-Party Deliveries: We are not responsible for the behavior, delay, safety, or quality of services provided by third-party delivery partners (e.g., Swiggy, Zomato, Amazon, Uber) who access properties via our logs.
- Limitation of Liability: To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or safety, arising out of or related to your use of the Services.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Developer, its partners, officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your breach of these Terms, your misuse of the App or Services, your interaction with visitors, residents, or security guards, or any incorrect, false, or unauthorized data you submit to the system.
10. Termination
We reserve the right to suspend or terminate your account and block access to the Services immediately, without prior notice, if you breach these Terms, engage in illegal activity, or fail to pay subscription dues. Upon termination, your right to use the Services will immediately cease.
11. Governing Law and Dispute Resolution
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
- Jurisdiction: Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
